At Musclemania Fitness Megastore, we are committed to providing quality products and excellent customer service. Please read the following policy carefully before making your purchase. By placing an order with Musclemania Fitness Megastore, you acknowledge and agree to the following terms and conditions.

Refund Policy

Change of Mind

Musclemania Fitness does not provide refunds for change of mind.

Where approved by Musclemania Fitness in exceptional circumstances, an exchange or return may be considered solely at the discretion of Musclemania Fitness and subject to the conditions outlined below.

Manufacturer's Warranty & Warranty Claims

All products supplied by Musclemania Fitness are covered by the applicable manufacturer's warranty.

Should a fault arise during the applicable warranty period, Musclemania Fitness will assist the purchaser by liaising with the manufacturer, supplier or authorised service agent to facilitate inspection, assessment, repair or replacement in accordance with the manufacturer's warranty terms and the Australian Consumer Law (ACL).

The occurrence of a fault that is covered by the manufacturer's warranty does not, of itself, entitle the purchaser to a refund from Musclemania Fitness.

Where a product is capable of being repaired or replaced under the manufacturer's warranty or in accordance with the Australian Consumer Law, repair or replacement will be the applicable remedy.

The assessment of the nature, cause and extent of any fault will be carried out by the manufacturer, supplier or their authorised service agent following inspection of the product.

A customer's opinion or belief that a product has suffered a major failure does not constitute a determination that a major failure has occurred.

The determination of whether a product has suffered a major failure rests solely with the manufacturer, supplier or their authorised service agent following inspection and assessment of the product.

Where the manufacturer or supplier determines that a replacement machine is the appropriate remedy, a new replacement machine of the same model, or the nearest equivalent model where the original model has been discontinued, will be supplied.

A cash refund will not be provided by Musclemania Fitness solely because a replacement machine has been approved under warranty.

If an identical or equivalent replacement machine is unavailable, Musclemania Fitness may, at its sole discretion, offer the purchaser a store credit equal to the original purchase price of the equipment only.

This store credit:

• excludes all freight, shipping, delivery, installation, assembly or other service charges previously paid;
• is not redeemable for cash;
• may be used towards the purchase of another product stocked by Musclemania Fitness.

Nothing in this policy excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law that cannot lawfully be excluded.

Faulty Products

If you believe your product is faulty:

• Please contact Musclemania Fitness before returning any item.
• Do not return products without prior authorisation.
• We cannot accept responsibility for products lost or damaged during unauthorised returns.
• Warranty claims must include proof of purchase and sufficient information regarding the fault.
• Where required, the product must be made available for inspection by the manufacturer or authorised service technician.

If the manufacturer determines the product is covered by warranty, it will be repaired or replaced in accordance with the manufacturer's warranty conditions and Australian Consumer Law.

If the manufacturer determines the product is not faulty or that the issue is excluded from warranty, the purchaser will be responsible for all inspection, freight, collection and return costs.

Warranty Exclusions

The manufacturer's warranty does not cover damage or faults arising from:

• misuse or abuse;
• accidental damage;
• negligence;
• incorrect assembly or installation;
• improper maintenance;
• commercial use where the product is designed for domestic use;
• modifications or unauthorised repairs;
• failure to follow operating instructions;
• normal wear and tear;
• cosmetic damage not affecting operation.

Returns (Exceptional Circumstances Only)

Returns are accepted only where approved in writing by Musclemania Fitness.

If approved, the following conditions apply:

• the product must be unopened;
• unused;
• in its original packaging;
• complete with all accessories;
• in perfect resale condition;
• be a standard stocked product.

Approved returns will incur a restocking fee, with the amount determined solely at the discretion of Musclemania Fitness.

Original freight, shipping and delivery charges are non-refundable.

Musclemania Fitness reserves the right to refuse any return that does not satisfy these conditions.

Special Orders, Pre-Orders & Deposits

Products specially ordered from a supplier or manufacturer specifically for a customer are non-refundable and cannot be cancelled once ordered.

This includes, but is not limited to:

• special order equipment;
• custom products;
• made-to-order products;
• products sourced specifically for a customer's request;
• products not normally stocked by Musclemania Fitness.

Any deposit paid to secure a special order, pre-order or custom order is strictly non-refundable, regardless of whether the customer later changes their mind, no longer requires the item, or wishes to cancel the order.

Spare Parts – Returns & Refunds Policy

Please choose carefully when ordering spare parts.

All spare parts are special order items sourced directly from the manufacturer or supplier specifically for your order. These items are not stocked as standard retail products.

Accordingly:

• Spare parts cannot be returned.
• Spare parts cannot be exchanged.
• Spare parts are not refundable.
• Shipping, freight and postage costs relating to spare parts are also non-refundable.

Before placing your order, please carefully refer to your product's user manual to confirm the correct part name and item number.

If you are unsure, please contact Musclemania Fitness prior to ordering and we will gladly assist wherever possible.

Product Images & Descriptions

Product images are supplied by manufacturers and are intended as a guide only.

Actual products may differ slightly in appearance, colour, finish or specification due to ongoing manufacturer improvements and production changes.

Musclemania Fitness is not responsible for minor differences between website images and the product supplied.

Colours, finishes and accessories may vary without notice.

Products handmade in Australia or supplied in varying manufacturer colours are not eligible for return based solely on colour variation.

Shipping & Freight

Customers are responsible for all applicable freight, delivery and courier charges unless otherwise stated.

While Musclemania Fitness endeavours to arrange prompt dispatch and efficient delivery, once an order has been collected by the freight carrier, delays are outside our control.

Accordingly:

• delivery delays are not grounds for cancellation or refund;
• freight delays do not entitle the purchaser to compensation from Musclemania Fitness;
• any additional charges imposed by the freight company beyond the quoted freight cost remain the purchaser's responsibility.

Freight Damage, Loss or Delay

Risk in transit passes to the freight carrier once goods leave our premises.

If goods are damaged during transit:

• notify the freight carrier immediately;
• retain all packaging;
• contact Musclemania Fitness promptly so we can assist where possible.

Claims for freight damage or loss are the responsibility of the freight company.

Pricing Errors

Although every effort is made to ensure pricing accuracy, errors occasionally occur.

Where an item has been listed at an incorrect price due to typographical, technical or administrative error, Musclemania Fitness reserves the right to cancel or refuse any order placed at the incorrect price.

Any payment received will be refunded in full should this occur.

Limitation of Liability

To the fullest extent permitted by law, Musclemania Fitness accepts no liability for:

• consequential loss;
• indirect loss;
• loss of profits;
• loss of income;
• personal injury;
• property damage;
• delays;
• misuse or incorrect use of products;
• unauthorised alterations;
• failure to follow operating instructions.

Nothing in this clause excludes any liability that cannot lawfully be excluded under the Australian Consumer Law.

Policy Updates

Musclemania Fitness reserves the right to amend, update or replace these policies, terms and conditions at any time without prior notice.

The version published on our website at the time of purchase will apply to that purchase unless otherwise required by law.
